ORDER


ON THIS DATE, came on to be considered Plaintiff's motion to compel discovery and the Court finds and orders as follows:

Plaintiff seeks discovery of his dates of incarceration and of information related to his efforts to resolve the issues in this case prior to filing suit. Defendants have not responded to Plaintiff's motion.

The issue in this case is whether or not Plaintiff was incarcerated for 180 days past his scheduled release date. Therefore, Plaintiff shall be provided with records related to his jail and prison time credits. To the extent that Plaintiff seeks copies of Defendants' phone records and affidavits from non-parties documenting his attempts to resolve the issues in this case, his request is denied.

IT IS THEREFORE ORDERED that, on or before January 23, 2004, counsel for Defendants shall provide Plaintiff with true and correct copies of all documents reflecting dates of Plaintiff's incarceration from May 22, 1992 through February 3, 2000 in the Wichita County Jail, the Intermediate Sanction Facility in Fort Worth, in any Texas Department of Criminal Justice ("TDCJ") prison facility, in any facility housing inmates under contract with TDCJ and any other facility in which Plaintiff was incarcerated during this time.

A copy of this order shall be transmitted to Plaintiff and to Counsel for Defendants.

SO ORDERED.
