Appellate Division of the Supreme Court of New York, Fourth Department
Oct 1, 1933
240 App. Div. 866 (N.Y. App. Div. 1933)

Opinion

October, 1933.

Order reversed on the facts, without costs, and motion denied on ground that under the papers presented in this record there is insufficient probability of plaintiff's success in the action to warrant the granting of the order appealed from. ( Heyman v. Heyman, 119 App. Div. 182; DeVide v. DeVide, 186 id. 814; Domb v. Domb, 195 id. 526.) All concur; Edgcomb, J., not sitting.
