ORDER MODIFYING OPINION

RICHLI, J.

It is ordered that the opinion filed herein on March 12, 2008, be modified as follows: The second sentence of footnote 2 on page 5 is modified to read:

The motions in the Alvarado action were directed at 30 of the 35 plaintiffs, who owned 17 of the 20 homes.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
