ORDER


In a report and recommendation dated March 6, 2002, Magistrate Judge Eaton recommended the granting of defendants' motion for judgment on the pleadings dismissing the complaint and the denial of plaintiff's cross-motion for summary judgment. The Court granted plaintiff an extension of time within which to file objections. The time now has expired without plaintiff having done so.

For the reasons set forth in the report and recommendation, the Court grants defendants' motion for judgment on the pleadings dismissing the complaint and denies plaintiff's cross-motion for summary judgment. The Clerk shall close the case.

SO ORDERED.
