JUDGMENT


This appeal came on to be heard upon the record of the Chancery Court of Greene County and briefs filed on behalf of the respective parties. This Court is of the opinion that the judgment of the Chancery Court should be vacated and this case remanded.

It is therefore ORDERED and ADJUDGED by this Court that the judgment of the Chancery Court is vacated, and this cause is remanded to the Chancery Court of Greene County for a hearing on Husband's motion for contempt and for collection of costs below. On remand, a new trial judge is to be assigned to this case. Costs on appeal are taxed to the Appellee, Stefanie Lynne Brumit Durham, for which execution may issue, if necessary.
