Motion to dismiss that part of the appeal taken from the order dated December 10, 1959 affirming the order dated December 12, 1958 denying resettlement granted and that part of the appeal dismissed, without costs, upon the ground that the order sought to be appealed from does not finally determine the action within the meaning of the Constitution.

Motion to delete a portion of the record denied with leave to renew upon the argument.
