DOROTHY BROZOSKY, Respondent Below, Appellant, v. JEFFREY OUSEY, Petitioner Below, Appellee. No. 414, 1998. Supreme Court of Delaware. Submitted: May 4, 1999. Decided: May 5, 1999.

Court Below: Family Court of the State of Delaware, in and for New Castle County, File No. C.A. No. CN94-08222, Petition Nos. 94-05-0167-CV and 97-07180.

Before WALSH, HOLLAND and HARTNETT, Justices.

ORDER

This 5th day of May 1999, the Court having considered this matter on the briefs filed by the parties, has determined that: to the extent the issues raised on appeal are factual, the record evidence supports the trial judge's factual findings; to the extent the errors alleged on appeal are attributed to an abuse of discretion, the record does not support those assertions; and to the extent that the issues raised on appeal are legal, they are controlled by settled Delaware law, which was properly applied. Therefore, this Court has concluded that the judgment of the Family Court should be affirmed on the basis of and for the reasons assigned by the Family Court in its decision and order Dated August 28, 1998.

NOW, THEREFORE, IT IS HEREBY ORDERED that the judgment of the Family Court be, and the same hereby is, AFFIRMED.

BY THE COURT:

/s/ Maurice A. Hartnett, III

Justice
