ORDER


On January 5, 2009, non-party witness Cyrus Zulkarnaian Kazi's former employer, Agenda for Children Tomorrow (ACT), submitted a letter to this Court seeking guidance as to how to respond to a subpoena duces tecum that ACT received from defendant. The subpoena commands ACT "to produce and permit inspection and copying of . . . any and all emails, reports, memoranda, correspondence, etc. between plaintiff and/or her representatives Harvey Mars. Esq. and Cyrus Kazi from 2007 to date" by January 9, 2009. ACT indicates that the organization no longer has access to the email account Mr. Kazi used prior to the termination of his employment with ACT and that Mr. Kazi had represented to ACT that he had already submitted all of his correspondence from his ACT email account to the Court.

Accordingly, the Court hereby ORDERS that the parties appear for a telephone conference at 2 p.m. on January 7, 2009 to discuss the matter. After the conference, the Court will direct ACT as to whether any further action is necessary for ACT to comply with the subpoena.

The Clerk is directed to post this Order via ECF to the parties and to mail a copy of this Order to the witness, Mr. Kazi.
