ORDER PARTIALLY GRANTING DEFENDANT'S MOTION FOR SUMMARY
JUDGMENT AND DENYING PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
This case came on for hearing on December 19, 2013, to consider the Plaintiff's Motion for Summary Judgment (Doc. No. 150) and the Defendant's Motion for Summary Judgment (Doc. No. 125). Consistent with the Memorandum Opinion Partially Granting Defendant's Motion for Summary Judgment and Denying Plaintiff's Motion for Summary Judgment, entered contemporaneously, it is
ORDERED:
1. The Plaintiff's Motion for Summary Judgment (Doc. No. 150) is denied.
2. The Defendant's Motion for Summary Judgment as to Count III asserted under § 523(a)(6) (Doc. No. 125) is granted. Final judgment is entered in favor of Defendant, Robert J. Vega, and against Plaintiff, Scott A. Brown.
3. The Defendant's Motion for Summary Judgment as to Count I asserted under § 523(a)(2)(A) (Doc. No. 125) is denied.
