Brown v. Taylor

Court of Appeals of Texas, Fourth District, San Antonio
Mar 16, 2005
No. 04-05-00124-CV (Tex. App. Mar. 16, 2005)

Opinion

No. 04-05-00124-CV

Delivered and Filed: March 16, 2005.

Appeal from the 166th Judicial District Court, Bexar County, Texas, Trial Court No. 2003-CI-10628, Honorable David Berchelmann, Jr., Judge Presiding.

Dismissed for Want of Jurisdiction.

Sitting: Catherine STONE, Justice, Sarah B. DUNCAN, Justice, Karen ANGELINI, Justice.

MEMORANDUM OPINION

The trial court signed a final judgment on July 29, 2003. Because appellant did not file a motion for new trial, motion to modify the judgment, motion for reinstatement, or request findings of fact and conclusions of law, the notice of appeal was due to be filed on August 28, 2003. See TEX. R. APP. P. 26.1(a). A motion for extension of time to file the notice of appeal was due on September 12, 2003. See TEX. R. APP. P. 26.3. Appellant, however, did not file a notice of appeal or motion for extension of time until February 24, 2005. Appellant offers no explanation for failing to file the notice of appeal in a timely manner. Therefore, this appeal is dismissed for lack of jurisdiction. See TEX. R. APP. P. 42.3.
