Brown filed a petition for certification to the Connecticut Supreme Court for review of the Connecticut Appellate Court's decision in which, again, he raised a single issue: whether the Connecticut Appellate Court erred in affirming the trial court's decision that the newly discovered evidence, if presented at a new trial, was unlikely to produce a different result for Brown.

The operative petition contained other claims, including that McMahon rendered ineffective assistance of counsel at the hearing on the motion to suppress the victim's identification, at the criminal trial, and during the proceedings on the petitioner's petition for a new trial.
