Brown v. State

District Court of Appeal of Florida, Second District
Dec 10, 1999
746 So. 2d 545 (Fla. Dist. Ct. App. 1999)

Opinion

No. 98-00264.

Opinion filed December 10, 1999.

Appeal from the Circuit Court for Pinellas County; R. Timothy Peters, Judge.

Antonio R. Arnao, St. Petersburg, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Ann Pfeiffer Howe, Assistant Attorney General, Tampa, for Appellee.

In this appeal from his conviction and sentence for felony petit theft, Leonard Brown raises two issues, the first of which, an evidentiary question, has no merit. We write only to note that the second issue Mr. Brown has raised, concerning his habitual offender sentencing, has been disposed of in an independent appeal, Brown v. State, 24 Fla. L. Weekly D2558 (Fla. 2d DCA Nov. 10, 1999).

Accordingly, this matter is affirmed.

PARKER, A.C.J., and CASANUEVA and DAVIS, JJ., Concur.
