Brown v. State

District Court of Appeal of Florida, First District
Mar 25, 1996
670 So. 2d 168 (Fla. Dist. Ct. App. 1996)

Opinion

No. 95-3787.

March 25, 1996.

An appeal from Circuit Court for Escambia County; Joseph Tarbuck, Judge.

Nancy A. Daniels, Public Defender, and P. Douglas Brinkmeyer, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General, and William J. Bakstran, Assistant Attorney General, Tallahassee, for Appellee.

Although the sentencing guidelines scoresheet called for a maximum sentence of 59.5 months, the trial judge imposed a sentence of 60 months. Because no written reasons for departure were provided, we vacate the appellant's sentence and remand this case for resentencing within the guidelines. The appellant need not be present for resentencing.

ALLEN, MICKLE and LAWRENCE, JJ., concur.
