ORDER


Pursuant to 28 U.S.C. § 636(b), and an order of the court in implementation thereof, this action was referred to the United States magistrate judge for proposed findings and recommendation. On January 22, 2004, the Findings and Recommendation of the United States Magistrate Judge ("Report") were filed. On February 10, 2004, Petitioner filed his written response to the magistrate's judge's Report.

Having reviewed the pleadings, file and record in this case and the findings and conclusions of the magistrate judge, the court determines that the findings and conclusions are correct. Petitioner's objections are overruled, and the magistrate judge's findings and conclusions are hereby accepted as those of the court. Accordingly, Petitioner's "Petition For A Writ of Habeas Corpus By A Person In State Custody" is denied, and this action is hereby dismissed with prejudice.

It is so ordered.
