ORDER GRANTING APPLICATION TO PROCEED IN FORMA PAUPERIS


On May 23, 2005, petitioner filed with this Court an application to proceed in forma pauperis, along with a certified in forma pauperis data sheet from the institution in which he is incarcerated. While it does appear petitioner has in his account, the requisite funds to pay the filing fee, petitioner has represented to the Court that he does not have access to such funds at this time. Consequently, petitioner's motion to proceed in forma pauperis is GRANTED.

IT IS SO ORDERED.
