ORDER


Before the court are the Findings and Recommendation of the United States Magistrate Judge, filed July 1, 2004. Upon consideration, the court determines that the findings and conclusions are correct, and they are accepted at those of the court. Accordingly, Petitioner's motion for leave to file a late or out-of-time appeal is granted, and Petitioner's Notice of Appeal With Request for Certificate of Appealability, dated April 7, 2004 and file-stamped April 21, 2004, is deemed timely filed.

It is so ordered.
