JAMES PHILLIP BROWN v. KRYSTAL MICHELLE BROWN

LC No. 2019-001976-DM

ORDER

Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:

The motion to waive fees is GRANTED for this appeal only.

The claim of appeal is DISMISSED for failure to pursue the case in conformity with the rules. MCR 7.201(B)(3) and 7.216(A)(10). The Clerk of this Court provided notice regarding the nature of the defects in this filing, and one of the defects was not corrected in a timely manner by providing this Court with a copy of the February 11, 2024 order identified on the claim of appeal. Further, assuming a February 11, 2024 order does not exist and that appellant wanted to appeal the February 22, 2024 order, entered on the register of actions, that order was an order of civil contempt. An order of civil contempt is not appealable by right, i.e. by the filing of a claim of appeal. See In re Moroun, 295 Mich.App. 312, 329; 814 N.W.2d 319 (2012) (an "order finding a party in civil contempt is not a final order for purposes of appellate review. . ."). Dismissal is without prejudice to appellant filing a delayed application for leave to appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
