DECISION & ORDER ON MOTION

Motion by respondent on an appeal from a final judgment of the District Court of Suffolk County, Sixth District, entered June 26, 2013, to strike portions of appellant's reply brief. Separate motion by appellant to vacate the final judgment.

Upon the papers filed in support of the motions and the papers filed in opposition to appellant's motion, it is

ORDERED, on the court's own motion, that appellant's motion and respondent's motion are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion and respondent's motion are denied.

It is noted that this court will not consider any material that is improper or dehors the record (see Chimarios v Duhl, 152 AD2d 508 [1989]).
