DECISION & ORDER ON MOTION

Motion by respondent for leave to appeal to the Appellate Division from a decision and order of this court dated April 16, 2015, which determined an appeal from a final judgment of the District Court of Suffolk County, Sixth District, entered July 15, 2013. Separate motion by appellant to dismiss respondent's motion as untimely.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that respondent's motion and appellant's motion are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion and respondent's motion are denied.
