Other states utilize a similar definition. See, e.g., Brooks v. State, 80 Md. App. 118, 560 A.2d 56, 58 (1989) (alibi witnesses are those who show "that the defendant was not present at the time, place and date of the offense"); State v. Fechter, 397 N.W.2d 711, 712-13 (Iowa 1986) (accord). As is evident, the mere fact that a defendant has listed a witness as an alibi witness is not dispositive; the witness is only an alibi witness if the witness in fact provides the defendant with an alibi for the crime.
