ORDER ADOPTING REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE


THIS CAUSE is before the Court upon the Report and Recommendation prepared by United States Magistrate Judge Patrick A. White [DE #13] and Petitioner's Objections [DE #14]. Pursuant to 28 U.S.C. § 636(b)(1)(c), this Court conducted a de novo review of the entire court record and is otherwise fully advised in the premises. It is thereupon,

ORDERED AND ADJUDGED as follows:

(1) The Report and Recommendation [DE #13] of United States Magistrate Judge Patrick A. White is hereby ADOPTED.

(2) The petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 is hereby DISMISSED as time barred.

(3) All pending motions are DENIED AS MOOT.
