An appeal having been taken from an order of the Supreme Court, New York County, entered on or about February 5, 2016, and said appeal having been perfected, And, plaintiffs-appellants having moved for permission to orally argue the appeal and to expedite same (M-5714), And defendants-respondents having moved to dismiss the appeal, or in the alternative to extend the time for defendants to file a response brief (M-5900), Now, upon reading and filing the papers with respect to the motions, including the stipulation by the parties dated December 27, 2016, and due deliberation having been had thereon, it is Ordered that defendant-respondent's motion is granted to the extent that the appeal is dismissed as moot (M-5900). Plaintiffs-appellants motion is denied as academic (M-5714).
