Opinion No. 99-199
September 22, 1999 ORDER
Petitioner has filed a petition for a writ of certiorari asking this Court to review the Court of Appeals' decision in Brockbank v. Best Capital Corp., Op. No. 99-UP-098 (S.C.Ct.App filed February 18, 1999). We grant the petition as to that portion of petitioner's Question III which alleges the Court of Appeals erred in remanding the case to the trial court to determine whether respondent's departure from the home divested him of his rights under Articel 9 of the Uniform Commercial Code, S.C. Code Ann. § 36-1-101, et. seq. (1977 Supp.1998). The parties are also directed to brief the following question:
Did the lower court erred in finding that respondent's departure from the home divested him of his rights under Article 9?
We deny the petition as to the remaining questions. The parties shall proceed to serve and file the appendix and briefs as provided by Rule 226(h), SCACR.
