KUHN , J., concurs in part and dissents in part. I concur in the denial of the writ with regard to Christie Broadhead's punitive damage claims. However, I dissent and would grant the writ application on the issue of future lost wages as the question of whether Broadhead is disabled or not is purely a factual question. I believe there are facts which suggest plaintiff may be entitled to these damages and the trial court, on summary judgment, should not weigh the evidence.
