ORDER
In accordance with the accompanying Memorandum Opinion, it is, hereby, ORDERED that:
1. Plaintiff's Motion to Compel Discovery [#73] is granted in part and denied in part; and it is FURTHER ORDERED that
2. Defendant Smoot's Motion to Compel WMATA to Answer Interrogatories and Respond to a Request for Production of Documents [#84] is denied as moot; and it is FURTHER ORDERED that
3. Motion to Quash Subpoena [#90] is denied; and it is FURTHER ORDERED that
4. By March 15, 2005, the District will conduct another search for the Smith statement and will file a memorandum with affidavits that describe its search efforts in reasonable detail. Plaintiff may respond to the memorandum by March 22, 2005; and it is FURTHER ORDERED that
5. Quinn provide plaintiff's counsel with three dates during the months of February and March on which he is available to be deposed in Frederick, Maryland. After one of the dates has been chosen and a specific location has been identified, Quinn shall appear for his deposition or face contempt of court. The deposition shall last no longer than four hours.
