Briggs v. Bradshaw

District Court of Appeal of Florida, Fourth District
Feb 29, 2008
980 So. 2d 1079 (Fla. Dist. Ct. App. 2008)

Opinion

No. 4D08-760.

February 29, 2008.

Petition for writ of habeas corpus to the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Nancy Perez, Judge; L.T. Case No. 08CF002161.

Carey Haughwout, Public Defender, Daniel Cohen and Carol Bickerstaff, Assistant Public Defenders, West Palm Beach, for petitioner.

Bill McCollum, Attorney General, Tallahassee, and Don M. Rogers, Assistant Attorney General, West Palm Beach, for respondent.

Regulo Briggs filed an emergency writ of habeas corpus after the trial court denied bond without considering the applicable standards. See Vailbailon v. Bradshaw, 971 So. 2d 289 (Fla. 4th DCA 2008); Yeary v. Bradshaw, 931 So. 2d 1060 (Fla. 4th DCA 2006). See also Adams v. State, 965 So. 2d 364 (Fla. 4th DCA 2007). We grant the petition and accept the state's limited concession that the case be remanded to the circuit court for the purpose of holding a hearing to consider the issues concerning Briggs's request for bond.

WARNER, GROSS and TAYLOR, JJ., concur.
