ORDER

Appellants James Andrew Brenek, Individually and as Independent Administrator of the Estate of James Andrew "Drew" Brenek, II, Deceased; and Rhonda Brenek (collectively "the Breneks") filed a motion to dismiss their appeal against appellee, Frank Jaap. See Tex. R. App. P. 42.1. The motion is GRANTED. Accordingly, the Breneks' appeal is DISMISSED.

The appeals of appellants Mark Jacobs, Larry Floyd, Richard Riggs, Will Smith, and Cimarron Engineering, LLC, remain pending.
