DECISION & ORDER ON MOTION

Motion by the appellant to hold in abeyance an appeal from an order of the Supreme Court, Queens County, dated July 1, 2012, pending, inter alia, expiration of the plaintiff's time to file a notice of appeal from the judgment entered March 7, 2013, in the above-entitled action.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that the appeal is held in abeyance until July 1, 2013, on condition that on or before May 15, 2013, the appellant supply proof that the judgment in the above-entitled action was served on the plaintiff with notice of entry.
