According to rule 500.6 (a) of the Rules of Practice of the Court of Appeals (22 N.Y.CRR 500.6 [a]) an appeal to this court must be argued or submitted within nine months after the appeal is taken. Otherwise, it must be dismissed by the clerk, absent extraordinary circumstances.
