Appealed from Webster Parish No. 79,857.

Before PITMAN, STONE, and HUNTER, JJ.

ORDER OF DISMISSAL

This matter is before the Court on jurisdictional check and the appellee's motion to dismiss the appeal. Review of this record reveals that the appellant seeks review of the trial court's October 10,2023, judgment, which was already the subject of the appeal in No. 55,892-CA. The October 10, 2023, judgment was affirmed in No. 55,892-CA by this Court on August 28, 2024, and the appellant did not timely seek further review with the state supreme court. Accordingly, the appellant's right of appeal of the October 10, 2023, judgment is exhausted, and under La. C.C.P. art. 2162, there is no longer a right to appeal this judgment. Accordingly, this appeal is hereby dismissed.

The appellee's motion to dismiss the appeal is denied as moot.
