This case was assigned to this Division of the Court by Order dated October 4, 2021.
On January 26, 2023, respondent filed with the Court a Motion for Leave to File a Sur-Reply to Petitioners' Reply to Respondent's Response to Petitioners' Motion to Compel Production of Documents (hereinafter Respondent's Motion for Leave to File a Sur-Reply) (Index No. 32). Respondent concurrently therewith lodged Respondent's Sur-Reply to Petitioners' Reply to Respondent's Response to Petitioners' Motion to Compel Production of Documents (hereinafter Respondent's Sur-Reply) (Index No. 33).
On February 1, 2023, petitioners filed with the Court a Motion for Leave to File Response to Respondent's Sur-Reply (Index No. 34) and concurrently therewith lodged Petitioners' Response to Respondent's Sur-Reply (Index No. 35).
The Court will be addressing Petitioners' Motion to Compel Production of Documents (Index No. 21), filed with the Court on August 12, 2022, by separate order.
Upon due consideration, and for cause, it is
ORDERED that Respondent's Motion for Leave to File a Sur-Reply (Index No. 32), filed January 26, 2023, is granted and Respondent's Sur-Reply (Index No. 33) is hereby filed as of the date of this order. It is further
ORDERED that Petitioners' Motion for Leave to File Response to Respondent's Sur-Reply (Index No. 34), filed with the Court on February 1, 2023, is granted and Petitioners' Response to Respondent's Sur-Reply (Index No. 35) is hereby filed as of the date of this order.
