Brant v. Brant

Appellate Division of the Supreme Court of New York, First Department
Jul 13, 1961
14 A.D.2d 532 (N.Y. App. Div. 1961)

Opinion

July 13, 1961

Motion to dismiss appeal denied, with $10 costs. Motion to dispense with printing the record on appeal and appellant's points denied without prejudice, however, to a renewal thereof upon a proper showing that plaintiff-appellant does not possess funds with which to prosecute the appeal. That branch of the motion which seeks to dispense with the printing in the record on appeal of the exhibits is granted on condition that the originals thereof are filed with the Clerk of this court on or before the Wednesday preceding the first day of the term for which the appeal is noticed for argument.
