DECISION & ORDER ON MOTION

Motion by the respondent, in effect, to recall and vacate a decision and order of this Court dated May 10, 2011, which determined an appeal from an order of the Family Court, Nassau County, dated April 9, 2010, as corrected by an order of the same court dated May 17, 2010, in effect, for leave to serve and file a brief on the appeal, and to stay all proceedings in the Family Court, Nassau County, based on the decision and order of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is, in effect, to recall and vacate the decision and order of this Court dated May 10, 2011, is granted, and the decision and order of this Court dated May 10, 2011, is recalled and vacated; and it is further,

ORDERED that on or before November 7, 2011, the appellant shall serve her brief on appeal upon counsel for the respondent; and it is further,

ORDERED that the branch of the motion which is, in effect, for leave to serve and file a brief is granted, and the respondent's brief on the appeal shall be served and filed on or before December 12, 2011; and it is further,

ORDERED that the appellant's reply brief, if any, shall be served and filed on or before December 27, 2011; and it is further,

ORDERED that the branch of the motion which is for a stay is denied as academic as the decision and order of this Court dated May 10, 2011, has been recalled and vacated.
