RECOMMENDATION

This matter comes before the Court on the Report and Recommendation of U.S. Magistrate Judge Karen L. Strombom. Dkt. 36. The Court has reviewed the Report and Recommendation, objections to the Report and Recommendation, if any, and the remaining file.

The Report and Recommendation should be adopted and the petition dismissed. Further, no certificate of appealability should issue.

IT IS ORDERED THAT:

The Report and Recommendation (Dkt. 36) IS ADOPTED;

The Petition is DENIED and DISMISSED; and

Petitioner is DENIED issuance of the certificate of appealability.

The Clerk is directed to send uncertified copies of this Order to U.S. Magistrate Judge Karen L. Strombom, all counsel of record, and to any party appearing pro se at said party's last known address.
