Brenda Bradley v. David Swanson

LC No. 21-007249-CH

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction. The claim of appeal was not timely filed within 21 days of entry of the March 17, 2022 order. MCR 7.204(A)(1). "[E]ntry" means the date a judgment or order is signed, or the date that data entry of the judgment or order is accomplished in the issuing tribunal's register of actions." MCR 7.202(A). Moreover, the March 17, 2022 order was not the final order pursuant to MCR 7.2O2(6)(a)(i). It was a postjudgment order implementing the trial court's February 28, 2022 order, which provided that defendant was afforded title to the subject property. Dismissal is without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
