December 11, 1942.

Present — Martin, P.J., Townley, Untermyer, Cohn and Callahan, JJ.; Townley, J., dissents and votes to reverse and grant the motion on the ground that the membership in the New York Stock Exchange is the individual asset of a single partner and not an asset of the firm.


Order affirmed, with twenty dollars costs and disbursements, with leave to the defendants to answer or otherwise move with respect to the complaint within ten days after service of order, on payment of said costs. No opinion.
