We are of opinion that in the interests of justice this case ought to be retried, and that both sides should have an opportunity to fully present their evidence. Therefore, the judgment is reversed and a new trial granted, with costs to abide the final award of costs. Mills, Rich, Putnam, Kelly and Jaycox, JJ., concur.
