Boyd v. Swanson

Appellate Division of the Supreme Court of New York, Fourth Department
Jun 18, 1943
266 App. Div. 904 (N.Y. App. Div. 1943)

Opinion

June 18, 1943.

Present — Crosby, P.J., Cunningham, Dowling, Harris and McCurn, JJ.

Judgment and order affirmed, with costs. All concur, except Crosby, P.J., and Dowling, J., who dissent and vote for reversal and for granting a new trial on the ground that the verdict is against the weight of the evidence. (The judgment is for plaintiff in an automobile negligence action. The order denies a motion for a new trial.)
