IN THE MATTER OF DARRELL BOYD, PETITIONER-APPELLANT, v. WILLIAM W. NAPIER AND JUSTIN FEASEL, RESPONDENTS-RESPONDENTS.


PRESENT:

Appellant having moved for permission to proceed as a poor person and assignment of counsel on the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Monroe on April 22, 2016, and having moved for mandamus relief, Now, upon reading and filing the affidavit of Darrell Boyd sworn to May 17, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for permission to proceed as a poor person is denied on the ground that the facts set forth by appellant fail to demonstrate merit to the appeal, and

It is further ORDERED that the motion insofar as it seeks mandamus relief is denied, and

It is further ORDERED that the motion insofar as it seeks assignment of counsel is denied.
