On August 14, 2017, this Court issued an order "stay[ing] further proceedings in the trial court to enforce any recommendations by the commissioners," but ordered that "the commissioners may complete their report." The commissioners subsequently served their "Initial Report of Commissioners" on the parties on September 22, 2017, and the report was filed in the trial court on September 25, 2017. On September 29, 2017, appellee Molly Bowman Stephens filed with the trial court a "Motion for Additional Instructions Concerning the Commissioners' Initial Report" that is scheduled for hearing on October 16, 2017.
Appellants Robert Hardie Tibaut Bowman and Powers L. Bowman have filed a motion with this Court requesting confirmation that our August 14, 2017 order applies to stay any further action following the issuance of the commissioners' initial report, including the filing of objections that could be required by Rule 771 of the Texas Rules of Civil Procedure and the trial court's planned hearing on appellee's motion on October 16, 2017.
We grant appellants' motion and supplement our August 14, 2017 order to stay (1) the trial court from taking any action on the Stephens's motion or any other objections to the commissioner's initial report or any requests by any party for additional instructions or for the commissioners to take any further action and (2) the commissioners from taking any further action.
