Proceeding in prohibition by E. L. Bowes, and others, to restrain the Superior Court of Alameda County and John J. Allen, judge thereof, from taking any further proceeding in an action upon a tender which was made to named petitioner when he was brought into the jurisdiction upon an order to take his deposition.

Peremptory writ of prohibition issued.
