LEMAR ALLEN BOWERS & MELANIE HALL BOWERS, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge

Proceedings in this case are currently stayed. See 11 U.S.C. § 362(a)(8). On August 27, 2024, respondent filed a Status Report. Therein, respondent advises: (1) that petitioner LeMar Allen Bowers' Chapter 11 case before the United States Bankruptcy Court for the Eastern District of Virginia (No. 3:20bk34139) remains pending; but (2) that petitioner Melanie Hall Bowers' Chapter 13 case before the United States Bankruptcy Court for the Eastern District of Virginia (No. 3:20bk33854) has been dismissed and closed.

However, it appears that petitioner Melanie Hall Bowers may have commenced an additional case before the United States Bankruptcy Court for the Eastern District of Virginia by filing a Chapter 13 petition on March 12, 2024 (No. 3:24bk30947).

Upon due consideration of the foregoing, it is

ORDERED that, on or before September 30, 2024, the parties shall file a joint report regarding the then-present status of this case and petitioners' respective bankruptcy proceedings, including any additional proceedings that may have been commenced by petitioner Melanie Hall Bowers. In their joint report, the parties shall address whether, pursuant to 11 U.S.C. section 362(a)(8), proceedings in this Tax Court case remain automatically stayed as to petitioner Melanie Hall Bowers as a result of any additional bankruptcy proceedings she may have commenced.
