ORDER
Plaintiff's attorney, Wolf Haldenstein Adler Freeman Herz LLP, having made an application to withdraw as counsel for the Plaintiff in this action (the "Application") and there being a hearing held before the undersigned on October 17, 2002, it is the hereby ORDERED, that the Application is granted for the reasons stated on the record at the October 17, 2002 hearing, it is further ORDERED, that if Plaintiff wishes to pursue this action and/or defend the counterclaims asserted in the action he must (1) file a notice of appearance by new counsel or appear pro se within thirty (30) days of the date of this Order and (2) appear by new counsel or appear pro se at the initial pretrial conference to be held in Courtroom No. 444, 40 Foley Square, New York, New York 10007, which is adjourned to December 13, 2002 at 3:30 p.m., it is further ORDERED, that if Plaintiff fails to appear in this action as provided in the preceding paragraph, this action may be dismissed without further notice and with prejudice for failure to prosecute, and judgment by default may be entered in connection with the counterclaims asserted in this action if Plaintiff fails to make the required appearances and file timely responses to the counterclaims, it is further ORDERED, that Plaintiff's time to respond to the counterclaims asserted in this action is extended to December 11, 2002, it is further ORDERED, that if Plaintiff appears pro se in this action, he shall contact the Pro Se Office in Room 230, 500 Pearl Street, telephone number (212) 805- 0177 for information concerning prosecution of this action, and it is further
ORDERED, that Plaintiff's former counsel Wolf Haldenstein Adler Freeman Herz LLP, shall serve a copy of this Order promptly upon Plaintiff and Defendants.
