DECISIONS Pursuant to Rule 1:28.

We reverse so much of the judgment as dismisses the plaintiff's cause of action for fraud. The fraud claim is remanded for an assessment of damages consistent with the memorandum and order of the Appeals Court. In all other aspects, the judgment is affirmed.

This decision pursuant to Rule 1:28 revised an earlier decision pursuant to Rule 1:28. See 69 Mass. App. Ct. 1113 (2007). — REPORTER.
