The Court has determined that it should decline to accept jurisdiction in this case. See Jackson v. State, 31 Fla. L. Weekly S53 (Fla. Jan. 26, 2006); see also Reese v. State, 896 So. 2d 807, 808 (Fla. 3d DCA 2005) (distinguishing Smith v. State, 842 So. 2d 1047 (Fla. 3d DCA 2003)); Taylor v. State, 897 So. 2d 495, 496 (Fla. 3d DCA 2005) (same). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).
