In lieu of granting leave to appeal, the matter is remanded to the Court of Appeals to reconsider its order of December 23, 1997 granting respondent's motion for actual fees and costs. MCR 7.302(F)(1). Such reconsideration should focus on the apparent acceptance of the petitioner's second brief as evidenced by the February 19, 1997 order of the Court of Appeals which denied respondent's motion to dismiss which was premised among other things, on the contention that the petitioner's brief was not in conformance with the court rules. Upon reconsideration, the Court of Appeals is to grant whatever relief, if any, it finds appropriate under the circumstances. Jurisdiction is not retained. Court of Appeals No. 192933.
