ORDER

PER CURIAM

Pending before the Court is the District Clerk and Court Reporter's motion for extension of time to file the record. This Courts order issued October 10, 2023, abated this appeal and remanded to the trial court for a hearing to determine whether Appellant wishes to continue the appeal and whether Appellant had been deprived of a record.

On November 8, 2023, the Court received a letter from Diane Pattillo, Court Reporter for the 109th District Court of Andrews County, Texas, advising that Appellant's Attorney, Lane Haygood, had filed designation of record and trial court hearing had been cancelled. On November 30, 2023, Sherry Dushane, District Clerk for the 109th District Court of Andrew County, Texas, filed the clerk's record.

Therefore, on the Court's own motion, the above-styled and numbered cause is hereby REINSTATED. The Court GRANTS Diane Pattillo's extension of time to file the reporter's record and DENIES as moot the District Clerk's request for extension of time. The reporter's record is now due December 31, 2023.

Accordingly, our order of October 10, 2023, has become moot and a hearing on this matter is no longer required.

IT IS SO ORDERED.
