On the Court's own motion, it is

ORDERED that the proceeding is transferred to the Appellate Division of the Supreme Court in the First Judicial Department for determination (see NY Const, art VI, § 4[i]); and it is further, ORDERED that all further proceedings in connection with this matter shall be conducted pursuant to the rules of the Appellate Division of the Supreme Court in the First Judicial Department.
