ORDER
Having considered plaintiff's motion for reconsideration of its December 24, 2003 Order granting defendant's motion for entry of judgment, together with the memorandum in support thereof, and having further considered the United States' lack of opposition to the relief sought therein, it is hereby
ORDERED that plaintiff's motion for reconsideration of the December 24, 2003 Order granting defendant's motion for entry of judgment is GRANTED; it is
FURTHER ORDERED that the Court's December 24, 2003 Order granting defendant's motion for entry of judgment is RECONSIDERED; it is
FURTHER ORDERED that this case is REOPENED; and it is
FURTHER ORDERED that the parties shall, on or before May 3, 2004:
(1) submit to the Court an agreed proposed amended judgment disposing of the merits of the case on remand, or, if the parties cannot agree on a proposed amended judgment;
(2) file briefs or memoranda (with proposed amended judgments) setting forth and explaining their respective positions on the content and substance of a proposed amended judgment disposing of the merits of the case on remand, with any responsive briefs to be filed on or before May 17, 2004; and
(3) advise the Court in writing whether the related case,American Home Products Corporation, et al. v. USA, Civil Action No. 97-1217, can be dismissed from the docket of the Court.
