I. The permanent location of the branch office of the Canton Exchange Bank (which was admittedly outside the Town of Ridgeland) was authorized by statute. The title cannot add to or extend the operation of the act." Giles v. Friendly Fin. Co. of Biloxi, 185 So.2d 659, 662 (Miss. 1966) (citing Bd. of Trs. of Kingston Consol. Sch. Dist. v. Forman, 233 Miss. 42, 101 So.2d 105 (1958)). Further, headings and titles generally "cannot limit the plain meaning of the text."
We cited the title to the Act not for the purpose of showing its entire scope and purpose but for aid in ascertaining legislative intent or relieving ambiguity in the body of the Act (though we see none). Board of Trustees of Kingston Consolidated School District v. Forman, 233 Miss. 42, 101 So.2d 102 (1958). Obviously the purpose of the Act was to provide for a uniform method of cancellation and non-renewal of automobile insurance policies. It is our duty to meet the real meaning of the framers.
The title cannot add to or extend the operation of the act. Board of Trustees of Kingston Consolidated School District v. Forman, 233 Miss. 42, 101 So.2d 102 (1958); and, Russell v. State, 231 Miss. 176, 94 So.2d 916 (1957). The title may not be used to create an ambiguity in the act.
The sole question presented to this court by this appeal is whether the one year limitation prescribed by Section 610, Code of 1942, or the four year limitation prescribed by Section 725, Code of 1942, is applicable. The order of the State Educational Finance Commission is a valid order, entered pursuant to jurisdiction conferred by the Legislature; and its effect is to legally transfer the students involved.
